PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, pleased to issue Writ of Certiorarified Mandamus, or any other appropriate Writ or Order or Direction calling for the records of the 2nd respondent with respect to the refusal of registration with refusal check slip bearing No.RFL/Manapparai/20/2025 dated 24.01.2025 and quash the same and consequently direct the 2nd respondent to register the document of sale executed by the petitioner and presented to the 2nd respondent with respect to survey No.216/2 and survey No.216/6 of Porunthalur Village, Kulithalai Taluk, Karur District. ORDER
The perusal of the impugned order shows that the property which is the subject matter of the Writ Petition had been attached by the learned District Munsif, Kulithalai in E.P.No.147 of 1988 in O.S.No.223 of 1980.
2.When there is an order of attachment, Section 22 B (3) of the Registration Act operates. Therefore, the Sub Registrar cannot register a document. The petitioner seeks liberty to move the learned District Munsif, Kulithalai, and raise the attachment and thereafter present the document for registration.
3.Liberty is granted. Petitioner is entitled to present the document for registration once the attachment order in E.P.No.147 of 1988 in O.S.No.223 of 1980 on the file of the District Munsif Court, Kulithalai is raised. With the above observation, the Writ Petition stands dismissed. No costs.
