Heard the learned counsel on either side.
2. The petitioner is a retired school headmistress. The petitioner wants to go abroad. She has therefore applied to the respondents to issue passport to her based on the petition mentioned application.
3. It appears that a criminal case was registered against the petitioner in the year 2006. If the criminal case had culminated into charge sheet, certainly the petitioner has to go only before the Court below. But if it is pending at FIR stage, https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD)NO.9688 OF 2020 then, there cannot be no objection. In order to clarify the same, this Court called upon the second respondent to make a statement. The learned Special Government Pleader appearing for the second respondent states that till date the case is not culminated into Calender case.
4. Since the matter is pending only at FIR stage, the first respondent is directed to issue passport to the petitioner based on her application, if the petitioner is otherwise eligible. The first respondent is directed to issue passport to the petitioner within a period of four weeks from the date of receipt of a copy of this order.
5. This writ petition stands allowed. No costs.
