Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India, seeking to issue a Writ of Mandamus, forbearing the respondents 1 and 2 to grant permission for conductance of public function to the 3rd respondent near Kamatchi Amman Karupanasamy Temple, Sayalkudi, Ramanathapuram District by putting stage, speakers and road procession, by crossing criminal trespass and causing law and order problems in the said locality.

O R D E R

This Writ petition has been filed to issue a Writ of Mandamus, forbearing the respondents 1 and 2 to grant permission for conducting public function to the 3rd respondent near Kamatchi Amman Karupanasamy Temple, Sayalkudi, Ramanathapuram District by putting stage, speakers and road procession, by crossing criminal trespass and causing law and order problems in the said locality.

2.The decision to grant permission to the public function in the above said place falls within the purview of the respondent Police in accordance with law, after considering the law and order situation in the particular area. Hence, this Court does not want to give direction to the respondents, in this regard.

3.In the result, this Writ petition is dismissed. No costs. Consequently, connected M.P.is closed. However, the respondent Police shall ensure public safety and convenience, before issuance of permission for the said public function in the place stated supra.
