Respondents PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C. praying to direct the Principal Sessions Judge (Special Cases for PCR) Court, Srivilliputhur at Virudhunagar District to consider the bail application of the petitioner if any filed by him on his surrender on the same day in Cr.No.71/16 on the file of the 2nd respondent.

ORDER

This application has been filed seeking a direction to the Court, which is dealing with the SC/ST Act cases to consider the bail application on the day of surrender itself. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents. 3.The petitioner along with others are arrayed as accused in respect of the offences under Sections 341, 294(b), 323, 355, 379 IPC r/w 3 (1)(r), 3(1)(s), 3(2)(V-a) of SC/ST Act of POA (Amended) Act 2015. The allegations against the petitioner is that on 20.05.2016 at 4.20 p.m., while the de-facto complainant went on a two wheeler with Rs.7,000/-, the accused persons also came in a two wheeler assaulted the de-facto complainant with chappal and forcibly took Rs.7,000/- on account of a sudden quarrel. 4.The learned Government Advocate (Crl. Side) would submit that the sum of Rs.7,000/- has already been recovered; investigation is also stated to be almost completed. He would further submit that the injured has been discharged from the hospital.

5.Under such circumstances, the Principal Sessions Judge (Special Court for PCR cases), Srivilliputhur, Virudhunagar District is directed to consider the bail application of the petitioner and pass orders on merits on the same day of his surrender.

With the above direction, this petition is disposed of.
