O R D E R

This Criminal Original Petition has been filed seeking to transfer the proceedings in S.C.No.11 of 2013 on the file of the Additional District Judge (Fast Track Court), Kumbakonam. 2.The reasons stated by the petitioner for seeking transfer of the case is not convincing and there is absolutely no ground to transfer the case from the file of the learned Additional District Judge (Fast Track Court), Kumbakonam.

3.In the facts and circumstances of the case, the presence of the petitioner is dispensed with before the court below on condition that the petitioner shall appear before the court below at the time of questioning under Section 313 of Cr.P.C and at the time of passing judgment. The petitioner shall be represented by a counsel before the court below and the counsel representing the petitioner shall cross examine the witnesses on the same day on which the witness is examined in Chief, by the prosecution.
