ORDER

This Criminal Original Petition is filed seeking a direction to direct the respondents 1 & 2 to provide adequate protection to the life and limb of the petitioner from the hands of the respondents 3 to 6.

2. The case of the petitioner is that he is residing in a house build up by her husband. The respondents 3 to 6 are neighbours. After the death of her husband, they are making trouble. While constructing a house, the third respondent demanded the land of the house. In respect of which, a complaint has been given on 12.02.2021. Enquiry was conducted and the respondents 3 to 6 were directed to avoid making any trouble. They also made undertaking that they will work out the remedy through Civil Court.

3. On 16.02.2021, at about, 09.00 a.m the private respondents 3 1/3

to 6 along with some other persons trespassed into the house of the petitioner and molested her and assaulted brutally. So, she was admitted in the hospital and she took treatment for 3 days. Even though, there was no action, by the second respondent. Again, she gave a complaint, there was no action.

4. When the matter came up for hearing, the learned counsel for the petitioner submitted that the copy of the discharge summary of the petitioner. So, on the previous hearing, the learned Public Prosecutor was required by this Court to instruct the second respondent to go into the genuineness of the document submitted by the petitioner.

5. When the matter came up for hearing today, the learned Additional Public Prosecutor would submit that based upon the complaint given by the petitioner, a case in Crime No.529 of 2021 was registered on 20.06.2021, against the private respondents as well as some other persons. A copy of the First Information Report is also been submitted by the learned Additional Public Prosecutor.

6. It appears that the private respondents are making continues trouble and she has been assaulted twice by the second respondent.

7. So, Considering the representation made by the petitioner, dated 14.06.2021, and depending upon the facts and circumstance and necessity, provide police protection to the petitioner within 15 days from the date of receipt of a copy of the order by considering proper enquiry by summoning the petitioner and the private respondent.

8. With the above direction, this Criminal Original Petition is disposed of.
