Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent Police for the offences under Sections 498 (A), 406 and 323 of I.P.C. in Crime No.46 of 2004 on the file of the respondent Police. 2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. side) appearing for the respondent.
3.When the matter was taken up for hearing, it is pointed out that the case was charge sheeted way back in the 2006 and taken on file in C.C.No.245 of 2006. The petitioner was not appearing since 2015. The case has been split up and a new number has been assigned viz., C.C.No.306 of 2006.
4.The petitioner is permitted to appear before the learned Judicial Magistrate No.II, Trichy on the next hearing date and apply for recall of warrant. The concerned trial Judge is directed to recall the warrant on the same day.

5.The learned counsel appearing for the petitioner on instructions undertakes that the petitioner would remit a sum of Rs.10,000/-(Rupees Ten Thousand only) towards Chief Justice Relief Fund and also that he would appear before the Court below regularly on all future hearing dates without fail.
6.If the petitioner fails to appear before the Court below for future hearings, he is entitled to file appropriate petition under Section 317 Cr.P.C. Even if on one hearing, he is absent and no application is filed for condoning his absence, this order granting anticipatory bail shall stand cancelled.
7.Recording the above said undertaking given by the learned counsel appearing for the petitioner, the Criminal Original Petition stands allowed accordingly.
