Mr.B.Thanga Aravindh, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.86 of 2023 on the file of the respondent Police. ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 448, 506(2) of IPC and Section 4 of TNPHW Act in Crime No.86 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 21.02.2023 at about 11.45 p.m., the 1/3

accused entered into the house of the defacto complainant, abused her in filthy language, assaulted her with iron rod, damaged the window glass and criminally intimidated her and also took away a sum of Rs.750/- from her house. 3.The learned counsel appearing for the petitioner submits that the petitioner has not indulged in any offence as alleged by the prosecution and he has been falsely implicated in this case.

4.The learned Government Advocate (Crl. side) has strongly objected for grant of anticipatory bail on the ground that the petitioner has three previous cases to his credit.

5.Considering the antecedents of the petitioner and the manner in which the occurrence had taken place, this Court is not inclined to grant anticipatory bail to the petitioner.
