PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to call for the records relating to the charge sheet in Spl.S.C.No.16 of 2023 by the learned Spl.Session Court for exclusive trial of cases under POSCO Act, Madurai and quash the same.

O R D E R

The petitioner has filed this petition, seeking to quash the proceedings in Spl.S.C.No.16 of 2023 on the file of the learned Special Session Court for exclusive trial of cases under POCSO Act, Madurai. 2.The learned Counsel appearing for the petitioner submitted that the parties have amicably settled their issue. Hence he prays to quash the proceedings against the petitioner.

3.The learned Government Advocate (Crl.Side) appearing for the respondent police submits that the victim is only 15 years old. Based on the complaint lodged by the victim, the respondent police has registered an FIR in Crime 17 of 2022 for the offence under Sections 4(2), 5(1), 6 and 59(n) of POCSO ACT, 2012.

4.Though the parties have settled their issue, considering the age of the victim, this Court is not inclined to entertain this petition. Accordingly, this criminal original petition is dismissed with liberty to the petitioner to 2/4

workout his remedy before the trial Court.
