The above petition has been filed seeking special leave to file the appeal, challenging the judgment of acquittal made in C.C.No.34 of 2020 dated 31.10.2023 on the file of the Judicial Magistrate No.2, Sivakasi.
2. Heard the learned counsel on either side.
3. The learned counsel appearing for the petitioner would submit that the petitioner filed a private complaint under Section 200 Cr.P.C. against the respondent for the offence under Section 138 of the Negotiable Instruments Act and after fulltrial, the learned Magistrate passed a judgment dated 31.10.2023 acquitting the respondent and challenging the judgment of acquittal, the present appeal came to be filed along with the above petition to grant special leave.
4. On perusing the petitioner's affidavit and also the impugned judgment, leave sought for is granted. Accordingly, this petition is ordered.
