Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 1 to 4 herein to initiate departmental action against the respondents 9 to 12 herein for registering false complaint against the petitioner in Crime No.24 of 2025 on the file of Inspector of Police, All Women Police Station, Ambasamudram, investigated by 5th respondent with the assistance of respondents 6 to 8 herein, prejudicially affecting the petitioners image and his family members in all respects. Mrs.K.Porkodi, learned Government Counsel, takes notice for the respondents 1 to 8.
2. With the consent of both sides, this writ petition is disposed of at the admission stage.
3. Heard the learned counsel for the petitioner and the learned Government Counsel appearing for the respondents 1 to 8.
4. This Writ Petition is being filed seeking a Writ of Mandamus to direct the respondents 1 to 4 to initiate departmental action against the respondents 9 to 12 for having registering a false complaint against the petitioner in Crime No.24 of 2025. Against the said complaint, the petitioner has filed Crl.O.P.(MD) Nos.16401 to 16403 of 2025 dated 07.11.2025 and this Court has been pleased to quash the said crime and issued a direction to the second respondent therein, namely, the Inspector of Police, All Women Police Station, Ambasamudram, Tirunelveli District, to conduct an enquiry into the aspect as to under what 3/7
circumstances a false complaint was lodged against the petitioner and to take appropriate action against those persons who were responsible for registration of the false complaint under the provisions of the POCSO Act for false prosecution. As no action has been taken by the respondents, the petitioner approached this Court by filing the present writ petition seeking relief as noted above.
6. When the matter is taken up for hearing for consideration, it is brought to the notice of this Court that an FIR was already registered in Crime No.17 of 2026 dated 28.04.2026 on the file of the sixth respondent and the same is pending for investigation.

In the light of the above, it is a matter for investigation on the said FIR and in case the involvement of the respondents 9 to 12 herein or any other persons is identified in the lodging of the false complaint against the petitioner, appropriate action has to be taken against those persons either in the said FIR or otherwise. As the investigation is pending in the above said FIR, this Court does not deem it appropriate to issue any further directions in the present writ petition at this stage. 4/7
However, this Court is of the considered view that the sixth respondent herein would conduct investigation in the said FIR lodged as expeditiously as possible.

In the circumstances, this Writ Petition is disposed of by directing the sixth respondent to expedite the investigation in the said FIR and conclude the same duly enquire into, as to whether the respondents 9 to 12 herein have played any role in lodging the false complaint against the petitioner and conclude the same as expeditiously as possible, at any rate, within six (6) months from the date of receipt of a copy of this order and file Final Report before the concerned Court.
9. With the said observations, this Writ Petition is disposed of. No costs.
