Respondents PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C. praying to direct the respondents 1 to 3 to give suitable direction to the 5th respondent not to harass the petitioner on the basis of the complaint given by the 6th respondent. ORDER

It is an application seeking a direction to the fifth respondent not to harass the petitioner under the guise of enquiry.

https://hcservices.ecourts.gov.in/hcservices/ 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondent.

3.The learned counsel for the petitioner would submit that based on the complaint given by the sixth respondent, the fifth respondent frequently called the petitioner to the Police Station and harassed him under the guise of enquiry in respect of a civil dispute.

4.The learned Government Advocate (Criminal Side) would submit that only on the basis of the complaint given by the sixth respondent herein, the petitioner was called for enquiry and not to decide the civil rights of the parties in the Police Station. He would further submit that the respondents did not cause any harassment to the petitioner.

5.If at all the presence of the petitioner is required, the respondents are directed to issue summons giving specific date, time and place and to record the statement of the petitioner. Excepting by issuing summons, the petitioner shall not be called to the Police Station.

6.With the above direction, this Criminal Original Petition is disposed of.
