ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused in Crime No.04 of 2016 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 366 IPC (Woman Missing) and hence, seeks anticipatory bail.
2. The case of the prosecution is that the daughter of the defacto complainant by name Ilantha aged 19 years was studying in Peravurani Venkateswara Arts and Science College for Women and on 04.01.2016, it is alleged that her daughter was missing and after enquiry, he came to know that her daughter has gone with one Parthasarathy S/o Ramanathan and the petitioner by name Lenin Kumar S/o Sivaji @ Ramachandra and Kannan have supported them and on his complaint, the case has been registered for the aforesaid offences. 3.The case of the petitioner is that the petitioner is innocent and the petitioner has not committed any offence as alleged by the prosecution. On 05.01.2016 and 06.01.2016 the defacto complainant and others tresspassed into the house of the petitioner and assaulted the petitioner and he was in-patient in Pudukkottai Government Hospital from 06.01.2016 till today and on his complaint the counter case has been registered in Crime No. 5 of 2016 against the defacto complainant and others.
4. The learned Government Advocate submitted that it is a case of case and counter and investigation is pending.
5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released https://hcservices.ecourts.gov.in/hcservices/
on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Alangudi, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
