PRAYER IN CMA(MD)No.SR52571 of 2017:

To setaside the Juegment and Decree passed in MCOP.No.52 of 2012 dated 03.11.2015 on the the file of the Motor Accident Clims Tribunal (Principal Sub-judge), Dindigul.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.A.JOHN XAVIER, Advocate for the petitioner and of MR.M.MURALI, Advocate on behalf of the 3rd Respondent, the court made the following order:- This petition has been filed to condone the delay of 689 days in filing the above civil miscellaneous appeal in C.M.A.(MD) No.SR52571 of 2017.

2. Considering the reasons stated in the affidavit filed in support of the petition and also considering the length of delay, this Court is inclined to condone the delay, subject to the payment of cost of Rs.2,500/- (Rupees Two Thousand Five Hundred only) to "Chief Justice Relief Fund", within a period of one week from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically, without any further reference to this Court.

3. This petition is accordingly ordered. On showing the proof of payment, Registry is directed to number the appeal, if the papers are otherwise in order and list the same on 03.08.2018, 'for admission'. Registry is also directed to print the name of Mr.J.S.Murali, learned Counsel for the third respondent, correctly, in the cause list.
