PRAYER :- For Bail in Crime No. 52/2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A2, who was arrested and remanded to judicial custody on 02.03.2023 for the offences punishable under Sections 147,294(b),323, 324, 307, 506(ii) of IPC @ 302 of IPC in Crime No.52 of 2023 on the file of the respondent police seeks bail. 2.The case of the prosecution is that due to some wordy quarrel while riding the two wheeler the accused persons joined together abused the son of the defacto complainant, attacked him with deadly weapons, due to which he sustained injuries and later died. Hence the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. He would also submit that the petitioner is in jail from 02.03.2023, hence he may be granted bail.

4. The learned Additional Public Prosecutor would submit that there existed dispute between two village people and for the occurrence that was held on 22.02.2023 two First Information Report came to be registered one in crime No. 51 of 2023 and the present First Information Report in Crime No.52 of 2023.

5. Taking into consideration the facts and circumstances of the case and also the serious allegations levelled against the petitioner and also the fact that the petitioner was in judicial custody only from 02.03.2023, this Court is not inclined to grant bail to the petitioner.

6. Hence the petition stands dismissed.
