PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, directing the respondents not to harass on the basis of D.K.Basu case Vs. WestBangal and not to interfere the civil dispute.

O R D E R

This Criminal Original Petition has been filed to direct the respondents not to harass on the basis of D.K.Basu case Vs. WestBangal and not to interfere the civil dispute.

2. The case of the petitioner is that the defacto complainant/fourth respondent herein, who is the Police Officer, by misusing his power, has given a false complaint against the petitioner. Based on the false complaint, the third respondent is continuously harassing the petitioner.

3. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

Crl.O.P.(MD)No.7957 of 2021 based on the complaint given by the fourth respondent against the petitioner, a case in Crime No.64 of 2021 has been registered for the offence under Sections 294(b), 427, 506(ii), 379 of IPC. Thereafter, the petitioner has given a complaint against the fourth respondent on 15.06.2021 and C.S.R.No.140 of 2021 has been assigned and it is pending for enquiry.

5. Considering the above submission, this Court is of the view that since the case has been registered against the petitioner, he has to face the investigation appropriately and nothing survives for consideration in this matter. Hence, the Criminal Original Petition is disposed of.
