For Respondent : Mr.P.Kottaichamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No. 42 of 2016 on the file of the respondent Police.

ORDER : The Court made the following order :- The respondent police registered a case as against the petitioner in Crime No.42 of 2016 for the offence under Sections 294(b), 326, 307 and 506(ii) IPC. Therefore, the petitioner has filed this petition seeking anticipatory bail. 1/3

2. The case of the prosecution is that due to property dispute, the petitioner abused the defacto complainant, assaulted him with knife and caused injuries to him.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution, hence, prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent strongly opposes to grant bail on the ground that the investigation is pending. He further submits that the petitioner is having six previous cases.

5. Considering nature of allegation as against the petitioner and considering the antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Hence, this Petition is dismissed.
