ORDER
It is an application seeking a direction to the learned Juvenile Justice Board, Madurai to consider the bail application of the the petitioner on the same day of his surrender in Crime No.219 of 2016.
2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondents. 3.A case in Crime No.219 of 2016 has been registered against the petitioner along with others in respect of the offences under Sections 147, 148, 341, 323, 324, 506(ii) and 392 IPC r/w 3 (1)(r), 3(1)(s) of SC/ST Act. petitioner is that on 18.02.2016 at about 02.00 pm. there is a dispute between two communities and at the time when the defacto complainant came there, the accused Nos.1, 2 and 8, abused his caste name and caused injury on his head.
4.The learned Government Advocate (Crl. Side) would submit that accused Nos.1 to 3 are in custody in connection with Crime No.219 of 2016 and investigation is almost completed. 5.A perusal of FIR would show that there are only two named persons as accused viz., Mondu S/o.Muthaiah Servai and Palani. The allegation in the FIR is against the said Mondu and rest of them are stated to have assaulted the defacto complainant only by using hands.
6.Under such circumstances, the Juvenile Justice Board, Madurai is directed to consider the bail application of the petitioner and pass orders on merits on the same day of his appearance.
