This Petition is filed under Section 439 (2) of Criminal Procedure Code praying to cancel the bail granted to the respondent/Petitioner in Crl.OP(MD)No.8351/2018 dated 17.05.2018 on the file of this Honourable Court.
Prayer in CRL OP(MD) No.8351 of 2018:
This Petition is filed under Section 439 of Criminal Procedure Code praying to released on bail by the petitioner/accused in Crime No.111 of 2017 on the file of the respondent police. Order : This Petition is coming on this day and upon perusing the petition and the affidavit and perused the documents placed on record filed in support thereof and upon hearing the arguments of Mr.A.ROBINSON, Government Advocate (Criminal side) for the petitioner, and Mr.SELVAKUMAR, Advocate for sole Respondent this Court made the following order:- This Court by order dated 06.07.2018 had cancelled the bail granted on 17.05.2018in Crl.O.P.(MD).No.8351 of 2018. 2.It was stated that the said petition was filed by Advocate Thiru.Selvakumar.
After going through the contents of the petition, this Court came to the conclusion that the petitioner in the bail petition was clearly guilty of suppression of material facts. He had not come to the Court with clean hands. False averments have been made in the bail petition and dismissal of earlier criminal original petitions were not disclosed. Therefore, this Court called upon Thiru.Selvakumar to show cause as to why action should not be taken against him for the false averments set out in the bail petition.

3.Today, the counsel on record filed an affidavit stating that he has filed those applications based on the instructions of Thiru.J.Jeya Aron Raja, E.No.2925/2014. The said counsel is present before me. He in turn submits that the instructions were given to him by Thiru D.Senthil Rajan, E.No.1904/2003. 4.The Registry is to prepare a complaint against Thiru J.Jeya Aron Raja and Thiru D.Senthil Rajan before the Bar Council of Tamilnadu for initiating appropriate disciplinary action against them. The copy of the order passed by this Court in Crl.M.P(MD). No.5097 of 2018 dated 06.07.2018 shall be enclosed along with the said complaint.
5.The Bar Council of Tamilnadu shall enquire and complete the proceedings within a period of six months from the date of receipt of the communication from the Registry, Madurai Bench of Madras High Court, Madurai.
