O R D E R

This petition is filed by the petitioner to direct the respondents to give permission and adequate police protection for conducting 'Panguni Uthra Festival' in Arulmiku Kaduvetti Karuppasamy Temple at Venkatasalapuram Village, Thiruvengadam Taluk, Tenkasi District, on 11.04.2025.

2. According to the petitioner, the petitioner is the one of the temple Administrators of Arulmiku Kaduvetti Karuppasamy Temple, Venkatasalapuram Village, Thiruvengadam Taluk, Tenkasi District. The people in the said village constructed the said temple superstructure. The 2/6

fourth respondent has not contributed to the same. Thereafter, the fourth respondent filed a suit in O.S.No.19 of 2022 before the file of Principal District Court, Sankarankovil, seeking for injunction and to declare the sale deed dated 08.04.2022 as null and avoid and the same is pending. While so, now, the villagers decided to conduct 'Panguni Uthra festival' in the aforesaid temple on 11.04.2025, but the fourth respondent is causing disturbance to the same. Therefore, the petitioner sent a representation on 27.03.2025 to the third respondent and on 28.03.2025, he sent a representation through registered post to the respondents and the same have not been considered so far. Hence, this petition.

The learned Additional Public Prosecutor (crl.side) appearing for the respondents 1 to 3, on instructions, submits that in the year 2022, there was some amicable settlement between the parties through Peace Committee Meeting. As per Peace Committee Meeting, 'Panguni Uthra festival' has to be conducted by the fourth respondent, Petchimuthu Community group and 'Sivarathiri festival' has to be conducted by the Shanmugavel Community group. However, the representation of the petitioner is under consideration and the respondents will conduct 3/6

enquiry on the petitioner's representation and dispose of the same within two days from today.

4. Considering the limited scope of the prayer sought for in this petition, this Court, without issuing notice to the respondents 4 and 5, is inclined to pass order in this petition.

According to the petitioner, he sought for police protection for conduct of 'Panguni Uthra Festival' on 11.04.2025 in Arulmiku Kaduvetti Karuppasamy Temple at Venkatasalapuram Village, Thiruvengadam Taluk, Tenkasi District, to that effect, he sent a representations on 27.03.2025 and 28.03.2025 and the same have not been considered. The third respondent also admits that he received the petitioner's representation and the same is under consideration. Therefore, this Court directs the third respondent to consider the representations of the petitioner dated 27.03.2025 and 28.03.2025 and take appropriate decision, after affording opportunity of hearing to all the interested parties, within two days from today (i.e., 07.04.2025). 4/6

6. With the above direction, this Writ Petition is disposed of. No costs.
