For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor (Crl. side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER: For Anticipatory Bail in Crime No.90 of 2021 on the file of the respondent police.
ORDER: The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor (Crl.side) appearing for the respondent.
2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 147, 294(b), 341, 323 and 506(ii) of I.P.C., in Crime No.90 of 2021 on the file of the respondent police, seeks anticipatory bail.
3. The earlier Anticipatory Bail application came to be dismissed by this Court on 19.05.2021 which has been filed by the petitioner along with the co-accused on the ground that this petitioner is also involved in the some other cases. But today, when the matter came up for hearing, the learned Additional Public Prosecutor (Crl. Side) submitted that the petitioner is not involved https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD. No.8031 of 2021 in any other case of any nature. On the previous occasion, there was misconception of facts during the last hearing.
4. The learned Additional Public Prosecutor (Crl. Side) submitted that the injured has been discharged from the hospital on the same day of treatment. In cases of similar nature, this Court has already granted Anticipatory Bail to co-accused. In the view of the above, I am inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, petitioner is ordered to be released on bail in the event of arrest his appearance before the learned Judicial Magistrate No.II, Virudhunagar, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C scrupulously.
5. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
