O R D E R
[Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] This Habeas Corpus Petition is filed to direct the respondents to produce the body or person of a detenue namely, John Prathap Kumar, S/o.Mariyaraj, aged about 39 years before this Court.
2. Alleging that her husband aged about 39 years who was working as Program Head at Kodai F.M. 100.5 was found missing on and from 09.01.2025 and that no action was taken by the second respondent despite the registration of the case in Crime No.48 of 2025 for "man missing", hence the present Habeas Corpus Petition has been filed by the petitioner/wife.
3. This Court by order dated 08.04.2025 had issued notice to the respondents. Today morning, the learned Additional Public Prosecutor submitted that the missing person has been returned back to Page No.2 of 5
home and the second respondent has produced the alleged missing person before this Court today.
4. We enquired the alleged detenue/missing person. He submitted that the petitioner is his wife and on his own volition due to mental stress, he had gone to attend Kumbha Mela and after attending Kumbha Mela and other various places of spiritual journey, he has returned back to his home. He further submitted that he is not under illegal detention of anybody and now he has joined his wife, the petitioner herein. The petitioner / wife is also present before this Court.
5. Finding that the alleged missing person is not under illegal detention of anybody and that he expressed his willingness to go along with his wife, this Habeus Corpus Petition stands closed. [A.D.J.C., J.] [R.P., J.] 25.06.2025 Index : Yes / No : Yes / No rm Page No.3 of 5
