O R D E R

The present Petition has been filed by the accused persons /A1 to A4 seeking to quash the charge sheet in C.C.No. 136 of 2024, on the file of Judicial Magistrate, Additional Mahila Court, Thanjavur, wherein, the Petitioners have been charge sheeted for the offence under Sections 448,294(b),352, 324 and 506(ii) of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002.

2.A perusal of the charge sheet reveals that the Petitioners trespassed into the property of th defacto complainant and attacked her.

3.According to the learned counsel for the Petitioners, proceedings are pending before the Family Court in respect of matrimonial dispute and it is a false case and prays to quash the 2/5

charge sheet.

4.I have heard the submissions made on either side and perused the materials placed before this Court. 5.A perusal of the charge sheet reveals that a prima facie case has been made out against the Petitioners. It is also brought to the notice of this Court that three witnesses have been examined in the criminal proceedings.This Court finds no reason to quash the charge sheet.Therefore the trial Court is directed to dispose of the criminal proceedings pending against the Petitioners without being influenced by any of the observaions made in this order. Considering the age of the Petitioners 2 and 3, their appearance before the trial Court is dispensed with, except for the hearing dates, as required by the trial Court.

6.With the above directions, the Criminal Original Petition is dismissed. Consequently, connected Miscellaneous Petitions are closed.
