Respondents PRAYER : Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to direct the 3rd respondent to execute the order already passed by the 1st respondent in his order in O.M.No.J2/16654/2021 dated 29.05.2021 and consider the representation of the petitioner dated 26.03.2021 seeking to demarcate the boundaries and issue separate patta in the name of the petitioner in respect of the property in survey no.281/15 for the total extent of 50 cents situate at Chithalangudi Village, Vadipatti Taluk, Madurai District, within a time frame as fixed by this Court.

ORDER

This writ petition has been filed for the issue of a writ of mandamus directing the third respondent to consider the representation made by the petitioner on 26.03.2021, wherein, the petitioner has sought for the survey of the property and to demarcate the boundaries and to issue a separate patta in the name of the petitioner with respect to the subject property.

2. The case of the petitioner is that the subject property was purchased in the name of the petitioner by his mother through a registered sale deed dated 29.08.1986. The further case of the petitioner is that the property is situated in 2 survey numbers and the patta has been granted only in respect of the property in S.No.281/14A and no patta was issued insofar as S.No.281/15. W.P.(MD)No.10309 of 2021 same did not evoke any response, the present writ petition has been filed before this Court seeking appropriate directions.

3. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the third respondent to consider the representation made by the petitioner on 26.03.2021 and deal with the same on its own merits and in accordance with law and pass appropriate orders within a period of six weeks from the date of receipt of a copy of this order.

4. The petitioner is directed to make a fresh representation to the third respondent along with a copy of the relevant documents and also a copy of this order.

5. The writ petition is disposed of with the above direction. No costs.
