PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, To direct the Hon'ble Additional District and Sessions Court for the exclusive trial of PCR Act cases, Sivagangai District to consider bail application filed by the petitioner and pass order in the bail application filed by the petitioner on the same date of their surrender in Crime No.0120 of 2026 on the file of the Respondent No.2 in accordance with law.

ORDER

The present application has been filed by Accused Nos.1 to 3 in Crime No.0120 of 2026 on the file of the second respondent police seeking a direction to the Additional District and Sessions Court for the Exclusive trial for PCR Act Cases, Sivagangai District to accept the surrender of the petitioners and consider their bail application on the same day.

2. Considering the averments in the petition, this Criminal Original Petition stands allowed and a direction is issued as prayed for. The learned Additional District and Sessions Judge for the Exclusive trial for PCR Act Cases, Sivagangai District, is directed to consider the application on the same day after giving due opportunity to the defacto complainant.
