ORDER : The Court Made the following order :- The petitioner, who is arrayed as Accused No.2, apprehends arrest at the hands of the respondent police for the offence punishable under Section 420 IPC, in Crime No.27 of 2007, on the file of the respondent police and hence, seeks anticipatory bail.
2. The case of the prosecution is that on 20.02.2001, the accused persons received a sum of Rs.37,500/- from the de-facto complainant, promising to get a job for her husband in abroad and did not get the job and also refused to repay the amount to the de-facto complainant. When the same was demanded, the accused persons threatened the de-facto complainant with dire consequences. On complaint, case has been registered for the offence stated above.
3. Today when the matter is taken up for hearing, there is no representation on behalf of the petitioner. However, the learned Government Advocate (Criminal side) submitted that this is a case of job https://hcservices.ecourts.gov.in/hcservices/ racketing. The learned Government Advocate (Criminal side) further
submitted that absconding charge sheet has already been filed against the petitioner and the same is yet to be taken on file. If anticipatory bail is granted, the petitioner will tamper the witness and hamper the investigation.
4. Considering the serious nature of allegations levelled against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
