PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of CERTIORARI, calling for the records relating to the impugned order passed by the 1st Respondent, in P.G.No.134 of 2023, dated 24.10.2024, and quash the same as illegal.

ORDER

The present writ petition has been filed challenging the order of the first respondent who is the original authority under the Payment of Gratuity Act, 1972. The said order has been passed on 24.10.2024. 2.As against the order of the first respondent, a statutory appeal remedy is available under Section 7(7) of the Payment of Gratuity Act, 1972. In such circumstances, this Court is not inclined to entertain the present writ petition. 3.The period spent between 07.04.2025, till the date of receipt of a copy of this order from this Court shall be excluded, in case if an appeal is preferred before the appellate authority. The appeal shall be disposed of within a period of 3 (three) months from the date of filing of the appeal. 4.The name of the petitioner Panchayat has been wrongly mentioned as Santhampattai Village Panchayat. However, the correct name of the Panchayat is Sendurai Village Panchayat.

5.With the above said observations, this Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are also closed. 09.06.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR Note:- The Registry is directed to return the original impugned order after obtaining due acknowledgment from the learned Counsel appearing for the petitioner. 3/4
