For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.110 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147,294(b), 323 and 506(ii) of IPC, in Crime No.110 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that on 14.06.2021 when the defacto complainant was working in the clinic, at about 7.30 hrs, some persons under the influence of alcohol had come to the clinic and picked up quarrel with the defacto complainant. The defacto complainant had scolded them and sent them back and thereafter he came to know that one of the person is Sankar, S/o. Sinthamani. Then after 10-15 minutes Sankar came along with 7 to 8 persons to the clinic and attacked him and one Saravanan, who came for treatment, and they also criminally intimidated him. Hence the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case.

4. The learned Government Advocate (Crl.Side)appearing for the respondent would submit that injured is still treated as in patient. He would further submit that two previous case are pending against the petitioner in Parthibanur Police Station in Crime No.260 of 2012 under Sections 147,148,294(b),323,324,307 of IPC and Crime No.03/2013 under Sections 147,148,294(b),448,336,506(i) of IPC r/w.Section 3 of TNPPDL Act.

5. Taking into consideration the fact that the injured is still taking treatment as in patient and also the fact that two previous cases are pending against the petitioner, this Court is not inclined to grant bail to the petitioner.

6. Hence, the petition stands dismissed.
