PRAYER :- For Bail in Crime No.92 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A4, who was arrested on 25.03.2022 for the offences under Sections 341 and 394 of IPC @ 341 & 395 of IPC, on the file of the respondent police, seeks bail. 2.It is the case of the prosecution that the petitioner and the other accused persons joined together, followed the defacto complainant and snatched her gold chain and a sum of Rs.30,000/-. Hence, the present complaint has been filed.

3. The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution. Further, the property was recovered and the major portion of the investigation is completed and the petitioner is in prison for more than 40 days.

4.The learned Additional Public Prosecutor on instructions would submit that initially, the case was registered for the offences under Sections 341 and 394 of IPC and thereafter, it was altered for the offences under Sections 341 and 395 of IPC. He https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.8985 of 2022 would further submit that the petitioner/A4 is having two previous cases, out of which, one case was registered under Section 392 of IPC.

5.Considering the previous antecedents of the petitioner and that two previous cases are pending against the petitioner out of which, one case was registered under Section 392 of IPC, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition is dismissed.
