PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the fifth respondent to forward the petitioner family pension proposal to the second respondent and direct the second respondent to sanction and pay the family pension through the sixth respondent without any further delay and consequently to provide family pension to the petitioner. ORDER

The present writ petition has been filed seeking the issuance of a Writ of Mandamus directing the fifth respondent to forward the petitioner family pension proposal to the second respondent and direct the second respondent to sanction and pay the family pension through the sixth respondent without any further delay and consequently to provide family pension to the petitioner.

2. Mr. N.Sathish Kumar, learned Additional Government Pleader, takes notice for the respondents 1, 3 to 6. Mr.P.Gunasekaran, learned Standing Counsel, takes notice for the second respondent.

3. By consent of both parties, the writ petition is taken up for final disposal at the stage of admission.

4.The learned counsel appearing for the second respondent submitted that the petitioner's father, late M. Nagoor Pitchai, was working as a Physical Education Teacher under the fifth respondent school and retired on 31.01.1998. As of now, no family pension has been sanctioned to any of the legal heirs, as all of them have attained majority and none falls within the purview of the Tamil Nadu Family Pension Rules. However, the petitioner, who claims to be the third legal heir and is physically disabled, seeks grant of family pension. The petitioner has submitted a representation to the fifth respondent. 3/6

5. Therefore, the fifth respondent is directed to scrutinize the pension proposal and, if any additional documents are required, to instruct the petitioner to furnish the same. Thereafter, the fifth respondent shall forward the proposal to the second respondent.

6. The said exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order. Subsequently, the second respondent shall consider the same and pass orders on merits and in accordance with law within a period of four weeks thereafter.

7. With the above directions, the writ petition is disposed of. No costs.
