Criminal Original Petition filed under section 528 of BNSS, praying to direct the Learned Principal and District Sessions Judge and (Special Court for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act , 1989 (amended) 2015, Theni to accept the surrender of the petitioner and consider his bail.
ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon perusing the earlier order of this court dated 27.03.2025, made in Crl.O.P(MD) No.5672 of 2025 and upon hearing the arguments of Thiru.C. Jeganathan, Advocate for the Petitioner and of Thiru. M.Karunanithi, Government Advocate for the 1st and 2nd respondents, this Court made the following order: This petition has been filed seeking to amend the trial Court as learned Principal and District Sessions Judge, Special Court for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (Amended 2015), Madurai. 2.The learned Counsel for the petitioner would submit that in the prayer portion and in paragraph No.
4 of the order copy, the trial Court is wrongly mentioned as the learned Principal and District Sessions Judge, Special Court for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (Amended 2015), Theni instead of learned Principal and District Sessions Judge, Special Court for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (Amended 2015), Madurai.
3.The learned Government Advocate (Crl.Side) appearing for the respondent police also admitted that the FIR has been registered only by the second respondent and the same is pending with him. Therefore, the competent jurisdictional court is learned Principal and District Sessions Judge, Special Court for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (Amended 2015),
4.In view of the submission made by the respondent police, this petition is ordered.
5.Registry is directed to carry out necessary amendment as prayed for and issue a fresh order copy.
