THE HONOURABLE MR.JUSTICE K.RAVICHANDRABAABU Writ Petition (MD) No.2440 of 2015 Pushphavalli

...Petitioner

Vs.

1.The District Collector, Virudhunagar District, Virudhunagar.

2.The Tahsildar, Thirusuli Taluk, Virudhunagar District.

3.The Village Administrative Officer, Agathakulam Village, Narikudi Post, Thirusuli Taluk, Virudhunagar District.

...Respondents

Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 19.01.2015. For Petitioner : Mr.D.Selvanayagam for Mr.M.Ramu For Respondent : Mr.D.Muruganandam, Additional Government Pleader.

ORDER

Heard the learned counsel appearing for the petitioner and Mr.D.Muruganandam, learned Additional Government Pleader who takes notice for the respondents. By consent, the writ petition itself is taken up for final disposal at the admission stage.

2.The petitioner seeks for a Mandamus directing the respondents to consider her representation dated 19.01.2015 through which she is seeking for inclusion of her name as well as her daughter's name in the service register of her husband who is going to retire on 28.02.2015. 3.It is stated that the petitioner's husband is working as Village Assistant, who is not made as a party to this writ petition. However, the petitioner seeks for inclusion of her name and her daughter's name in the service register of the said person. 4.I am of the view that the representation made by the petitioner is totally misconceived in view of the fact that it is for the employee to give details as to who is the person to be nominated in the service register as his legal heir. If there is any dispute with regard to the nomination already made, it is for the petitioner to work out her remedy in the manner known to law and not by way of making a representation that too without the consent of the husband. Accordingly, https://hcservices.ecourts.gov.in/hcservices/

I find no merit in the writ petition to entertain this writ petition. Consequently, the writ petition is dismissed. No costs. Sd/- Assistant Registrar(Writs) /True copy/ Sub Assistant Registrar To 1.The District Collector, Virudhunagar District, Virudhunagar.

2.The Tahsildar, Thirusuli Taluk, Virudhunagar District.
