THE HONOURABLE MR.JUSTICE K.RAVICHANDRABAABU Writ Petition (MD) No.2443 of 2015 and M.P(MD)No.1 of 2015 Sandhya ...

Petitioner Vs.

1.The Secretary to Government, Higher Education Department, State of Tamil nadu, Secretariat, Chennai 9 2.Member Secretary, Teachers Recruitment Board, 4th Floor, EVK Sampath Maaligai, DPI Compound, College Road, Chennai 6.

... Respondents Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the 2nd respondent to select and appoint the petitioner as P.G Assistant (Economics) in GTW (General Turn women) in pursuant to the Advertisement /Notification in Advertisement No. 08/2014 dated 07.11.2014 and pass any other order or orders.

For Petitioner : Mr.T.A.Ebenezer For Respondents : Mr.J.Gunaseelan Muthiah, Government Advocate.

ORDER

Heard the learned counsel appearing for the petitioner and Mr.J.Gunasellanmuthiah, learned Government Advocate who takes notice for the respondents. By consent, the writ petition itself is taken up for final disposal at the admission stage.

2.The petitioner seeks for a Mandamus directing the second respondent to select and appoint her as P.G Assistant (Economics) in General Turn women category in pursuant to the advertisement/notification in Advertisement No.08/2014, dated 07.11.2014. https://hcservices.ecourts.gov.in/hcservices/ 3.The petitioner seeks for appointment to the post of Post Graduate Assistant in (Economics) subject. Admittedly, the requirement of

the educational qualification to the post is M.A (Economis) with B.Ed., and however, the petitioner is possessing only M.A.(Analytical Economics). Therefore, unless such post graduation degree obtained by the petitioner in Analytical Economics is considered as equivalent to that of M.A.Economics by the competent equivalence committee, the petitioner cannot seek for a mandamus as sought for in this writ petition. 4.Accordingly, I find no reason to entertain this writ petition at this stage.

However, the writ petition is disposed of by giving liberty to the petitioner to seek for issuance of equivalence certificate before the competent authority by making necessary application and as and when she gets such equivalence certificate, it is open to the petitioner to agitate the matter further for seeking appointment as sought for in this writ petition. No costs. Consequently, M.P(MD)No.1 of 2015 is closed.
