O R D E R
The present Writ Petition is directed against the impugned order, dated 02.07.2018 passed by the second respondent and quash the same, consequently directing the respondents to grant permission to perform the of cultural programme of "Adal Padal" to be conducted on 07.07.2018 in connection with the "Kovil Thiruvizha" of "Arulmigu Sree Mariamman Kovil" at Pandiyapuram, Thudaiyur, Manachanallur, Trichy District.
2.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.
3.According to the petitioner, he made a representation to the second respondent on 02.07.2018 to grant permission to conduct Aadal Padal programme on 07.07.2018. The said representation was rejected https://hcservices.ecourts.gov.in/hcservices/
on the ground that if the permission is granted, it will create law and order problem between the villagers by consuming alcohol. Challenging the aforesaid order, the present writ petition has been filed.
3.The learned Additional Government Pleader appearing for the respondents would submit that the second respondent has considered the said representation and rejected the same on the ground that if the permission is granted, it will create a law and order problem between the villagers by consuming alcohol and therefore, the petitioner's representation was rightly rejected by the second respondent.
4.For the reasons stated in the impugned order passed by the second respondent rejecting the representation of the petitioner on the ground that if the permission is granted, it will create a law and order problem between the villagers, there is no material has been placed before this Court to substantiate his contention for the rejection.
5.Considering the facts and circumstances of the case, this writ petition is allowed by setting aside the order passed by the second respondent, dated 02.07.2018 and remanded the matter to the second respondent to consider the representation of the petitioner, dated 02.07.2018 afresh, after providing opportunity to parties concerned, and pass orders on merits and in accordance with law, on or before 06.07.2018. No costs. Consequently, connected miscellaneous petition is also closed.
