Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned order passed by the 4th respondent in No.nil dated 31.7.2014 quash the same and direct the 4th respondent to grant re-employment to the petitioner till 31.5.2015 with all attendant benefits and pass such further or other orders. https://hcservices.ecourts.gov.in/hcservices/

ORDER

Heard the learned counsel appearing for the petitioner and Mr.V.Muruganandam, learned Additional Government Pleader takes notice for the respondents. By consent, the writ petition itself is taken up for final disposal at the admission stage.

2.The petitioner is aggrieved against the order of the fourth respondent dated 31.07.2014 and consequently seeking for a direction to the fourth respondent to grant reemployment to the petitioner till 31.05.2015 with all attendant benefits.

3.It is seen that the claim of the petitioner seeking for reemployment was rejected through the above said impugned order as early as on 31.07.2014 by stating that the work and conduct of the petitioner are not satisfactory. Even though such an order was passed on 31.07.2014, the petitioner has not chosen to challenge the same immediately. On the other hand, the present writ petition has been filed only at the fag end of the academic year. I do not think that the present writ petition could be entertained both on the ground of delay as well as on the ground that the management has found that his work and conduct are not satisfactory. When that being the contention, even to consider as to whether such finding is valid or not the petitioner has to come before this Court at an appropriate time.

Therefore, I find that the present writ petition filed after such a long time cannot be entertained. Accordingly, the same is dismissed. No costs. Consequently, M.P(MD)Nos.1 and 2 are closed.
