Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as Accused Nos.1,3 and 4 apprehend arrest at the hands of the respondent police for the offences punishable under Sections 498(A), 406, 294(b), 506(i) IPC and Section 4 of TNWH Act, in Crime No.9 of 2016, on the file of the respondent police and hence, seek anticipatory bail.

2.The case of the prosecution is that the marriage between the de facto complainant and A.1 tookplace on 20.02.2012. At the time of marriage, the de facto complainant gave 100 sovereigns of gold jewels and household articles worth of Rs.3,00,000/-. After marriage, the petitioners and other accused harassed her demanding additional dowry. On complaint case has been registered for the above said offences. 3.The case of the petitioners is that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. The petitioners did not demand any dowry and the de facto complainant left the matrimonial home on her own volition and she has given a false complaint and this Court granted anticipatory bail to the co-accused vide order dated 09.06.2016 made in Crl.O.P(MD)No.8881 of 2016.

4.The learned Government Advocate (Criminal side) appearing for the respondent submitted that investigation is pending. https://hcservices.ecourts.gov.in/hcservices/ 5.Considering the facts and circumstances of the case and also considering the fact that the co-accused have already been granted

anticipatory bail by this Court vide order dated 09.06.2016 made in Crl.O.P(MD)No.8881 of 2016, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Special Mahila Court cum Judicial Magistrate, Madurai, and on each of them executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the first petitioner shall report before the respondent police daily at 10.00 a.m. until further orders and the petitioners 2 and 3 shall report before the respondent police as and when required for interrogation.

The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 6.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which the petition for anticipatory bail stands dismissed. sd/- 17/06/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
