ORDER

It is an application seeking a direction to the I Additional District and Sessions Judge, PCR Court, Thanjavur to consider the bail application of the petitioners on the same day of surrender in Cr.No.80 of 2016 on the file of the respondent police. 2.Heard the learned counsel for the petitioners and the learned Government Advocate (Crl. Side) for the respondent.

3. The case in Crime No.80 of 2016 has been registered against the petitioners under Sections 341, 294(b), 324, 506(ii) IPC, 379 (NP) r/w 3(1)(r)(s), 3(2)(Va) of SC/ST (POA) Amendment Act, 2015, Act, 1989.

4.According to the petitioners, they did not commit any offence and because of the election dispute, this case has been foisted against them.

5.The learned Government Advocate (Criminal Side), on instructions, would submit that there are no materials to show that the petitioners have committed offence under Section 379 IPC. 6.Under such circumstances, the learned I Additional District and Sessions Judge, PCR Court, Thanjavur is directed to consider the bail application of the petitioners and pass orders on merits on the same day of their surrender.
