O R D E R

This Writ Petition has been filed seeking to quash the impugned proceedings dated 02.04.2025 and direct the second respondent to give permission and protection to perform the Aadal Padal on 07.04.2025 in respect of the temple festival of Panguni Thiruvizha in Arulmigu Manthai Muthallamman Thirukovil, situated at Sevanthampatti, Marungapuri Taluk, Trichy District.

2.The learned Counsel for the petitioner would submit that the petitioner is the one of the committee members of the said temple and the villagers decided to conduct festival for the said temple on 07.04.2025 and they also decided to conduct Adal Padal programme on 07.04.2025, to that effect, they sent a representation on 02.04.2025 to the second respondent. But the same has been rejected on the ground of law and 2/6

order issue. The petitioner undertakes to conduct the Adal Padal programme without any law and order issue. The second respondent cannot deny permission to conduct Adal Padal programme only on the ground of law and order issue. Therefore, the order passed by the second respondent is liable to be set aside.

3.The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner sent the representation seeking permission to conduct Adal Padal programme on 07.04.2024 for the panguni festival in the above said temple and the same was considered and permission was denied on the ground of law and order issue. Therefore, this petition is liable to be dismissed. 4.This Court heard both sides and perused the records. 5.The second respondent passed an order declining permission to conduct the Adal Padal programme on 07.04.2024 in the said temple. The reasons stated by the second respondent for declining permission to conduct the said programme is that there are chances for law and order issue, since all the villagers would gather in the particular place. second respondent cannot deny permission only on the ground of law and order issue. Since the Adal Padal Programme is one of the cultural programmes and more over, the petitioner also now undertakes to conduct the Adal Padal programme without any issue, this Court is inclined to grant permission for conducting the Adal Padal programme. 6.Accordingly, the impugned order is set aside and the permission is granted to conduct the Adal Padal programme on 07.04.2025 from 07.00 pm to 10.00 pm. The second respondent is directed to monitor the entire programme and the petitioner is also directed not to praise any particular community people and without any obscene acts, the programme has to be conducted.

6.With the above observations and direction, this Writ Petition is disposed of. Consequently, the connected miscellaneous petition is closed.
