Respondents PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C. praying to direct the petitioner to surrender along with bail petition and sureties to the learned Special Court for SC and ST (POA) Act and direct the learned Judge to consider the bail petition on the same day in connection with Crime No.76 of 2016 on the file of the 1st respondent.

ORDER

It is an application seeking a direction to the Special Court for SC/ST Act, Tirunelveli to consider the bail application of the petitioners on the same day of their surrender. 2.Heard the learned counsel for the petitioners and the learned Government Advocate (Crl. Side) for the respondents. 3.The learned counsel for the petitioners would submit that due to civil dispute, a false case has been registered against the petitioners in Crime No.76 of 2016 under Sections 294(b), 323 and 506(ii) IPC r/w Section 3(1)(r), 3(1)(s) and 392(V)(a) (V)(a) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and that the petitioners have not committed any https://hcservices.ecourts.gov.in/hcservices/

offence as alleged in the complaint.

4.The learned Government Advocate (Criminal side), on instructions, would submit that there is no injured in this case and the major part of the investigation is over. 5.Having regard to the facts and circumstances of the case, this Court directs the petitioners to surrender before the Court concerned within ten days from the date of receipt of a copy of this order and file necessary application for bail. The Court concerned shall consider the same and pass appropriate orders, on merits, on the same day of their surrender.

6.With the above direction, this Criminal Original Petition is disposed of.
