O R D E R

This Writ Petition has been filed to direct the respondents to consider the petitioner's representation dated 16.03.2026 and application in No. 2026/N105/21/002237 dated 23.03.2026 and consequently mutate the revenue records and transfer patta in respect of the property comprised in Survey No. 53/8A and 53/8B, Thanjavur District, in favour of the petitioner based on the decree in O.S.No. 195/2002 dated 13.07.2006 and the Court-executed registered sale deed bearing Document No.1720 of 2006, in accordance with Sections 3, 4 and 5 of the Tamil Nadu Patta Pass Book Act, 1983, within a time frame fixed by this Court.

The learned counsel for the petitioner submitted that the property in Survey No. 53/8 (subdivided into 53/8A and 53/8B), located in Thanjavur District and measuring approximately 5280 sq. ft., originally belonged to the defendants in the suit O.S. No. 195 of 2002 before the Principal Subordinate Judge, Thanjavur. A sale agreement existed between the plaintiff and the defendants namely Mary Anbu and others. However, as the sale was not completed, the petitioner initiated a suit for specific performance, which was decreed by the court in its judgment and decree dated 29.10.2003. Following this, the petitioner filed an execution petition, and the court subsequently executed a sale deed in favor of the petitioner in Doc. No. 1720 of 2006, dated 13.07.2006.

Through this, the petitioner has perfected title and is in possession of the property. Moreover, the petitioner submitted a representation on 16.03.2026 to the 3rd respondent, requesting the transfer of the patta in accordance with the decree and sale deed. As no action has been taken on this, the petitioner has now filed the present petition.

3. The learned Additional Government Pleader submitted that, while the suit was pending, Mary Anbu and Othersl sold the property to one Ramamurthy 3/6

on 30.10.2002. Therefore, the respondents submitted that the petitioner should have impleaded Ramamurthy as a party to the case. The said Ramamurthy had purchased the property when th suit was pending, hence it is affe ted by the Principles of ''lis pendens'' and the said Ramamurthy is not having any right.

Considering the facts and circumstances of the case, the Court directs the Tahsildar/3rd respondent to consider the petitioner's application dated 16.03.2026, after issuing notice to the petitioner, as well as to the individuals named Ramamurthy, Mary Anbu, Elansalin, Roshalin Angel, Branklin Immanuvel, Nelson, and Nepholean, who are parties to the suit. A personal hearing may be provided to all parties involved. . The said exercise shall be completed within a period of four months from the date of receipt of a copy of this order.
