PRAYER: Criminal Original Petition filed under Section 407 Cr.P.C. praying to withdraw the case in D.V.No.1 of 2016 on the file of the Judicial Magistrate No.II, Tuticorin and transfer the same any other competent Court.

ORDER

This petition has been filed to transfer D.V.No.1 of 2016, which is pending on the file of the learned Judicial Magistrate No.II, Tuticorin.

2.The main ground on which the transfer is being sought for, is that there is a life threat to the petitioners through the relative of the respondent. Except for the allegation, there is no other material that has been placed before this Court. The ground raised by the petitioners cannot be taken into consideration for the purpose of transferring the case. 3.In the facts and circumstances of the case, there shall be a direction to the learned Judicial Magistrate No.II, Tuticorin to complete the proceedings in D.V.No.1 of 2016, within a period of three months from the date of receipt of a copy of this order. 4.In the result, this Criminal Original Petition is dismissed, with the above direction. Consequently, connected miscellaneous petition is closed.
