For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.554 of 2021 on trye file of the respondent police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 4(1)(g), 4(1)(a) r/w 4(1-A) of the Tamil Nadu Prohibition Act in Crime No.554 of 2021, seeks anticipatory bail. 2.The case of the prosecution is that on 11.06.2021, when the police party conducted raid, they found four persons, near Perumalpatti Kundaru bridge. On seeing the Police, one person escaped and the police secured the other three persons. On search, they found that the accused persons were in illegal possession of 350 liters of wash to prepare illicti arrack. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated on the basis of the confession statement of the co-accused. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD)No.8030 of 2021 4.The learned Government Advocate(Crl.side) appearing for the respondent police opposed this petition on the ground that investigation is pending and there are two previous cases pending against the petitioner in Cr.No.418 of 2021 under Sections 20(b)(ii) A, 8(c) NDPS Act and in Cr.No.135 of 2021 under Sections 20(b)(ii)A, 8(c) NDPS Act.

5.Taking note of the fact that this case was registered only on 11.06.2021 and the fact that there are two previous NDPS cases pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
