ORDER : The Court Made the following order :- The petitioners, who is arrayed as accused Nos.2 to 5, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 306 of IPC @ 498(A) and 304(B) of IPC, in Crime No.
266 of 2016, on the file of the respondent police and hence, seek anticipatory bail. 2.The case of the prosecution is that A1, who is the son of the first petitioner fell in love with the deceased and married before 2 1⁄2 years. At the time of marriage, the parents of the deceased gave 40 sovereigns of gold and household articles worth Rs.1,00,000/-. After the marriage, A1 demanded 10 sovereigns of gold jewels. The parents of the deceased gave 10 sovereigns to A1 and even after that they have demanded more dowry. Due to that,t he deceased committed suicide by hanging.
3.The case of the petitioner is that the first petitioner is the father-in-law, the second petitioner is the brother-in-law, third petitioner is the mother-in-law and the fourth petitioner is the sister-in-law of the deceased. It is an admitted fact that the deceased and A1 fell in love and both eloped and got married and they are living separately. petitioners are innocent and they have not committed any offence as alleged by the prosecution.
4.The learned Government Advocate(Crl.side) submitted that already A1 was arrested and he is in judicial custody. 5.Considering the facts and circumstances of the case and also considering the fact that A1 was already arrested and he is in judicial custody and these petitioners are in-laws of the deceased and they were living separately, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Theni and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.00 a.m., until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
