O R D E R

This Writ Petition has been filed to direct the respondents to issue patta in the name of the petitioner based on the petitioner's application No. 2025/0103/13/356534., dated 29.01.2025.

2. The learned counsel for the petitioner submitted that the property in S.F. No. 184/4 originally belonged to one Meera Rawthar, who sold it to the petitioner's father, K. Velusamy, on 18.04.1965, as per Document No. 571 of 1965. After the death of the petitioner's father on 07.11.1976, by intestate. The petitioner, her mother, and sister have been in possession and enjoyment of the property. Subsequently, on 13.12.1991, a partition was executed among the legal heirs of Velusamy under Document No. 1364 of 1993. In this partition, the property in S.F. No. 184/4 was allotted to the petitioner under the 'A' Schedule, and a joint patta was issued under Patta No. 6445. Furthermore, on 06.05.2021, a registered partition deed was executed between the petitioner and her sister, as per Document No. 1010 of 2021, in which the property in S.F. No. 184/4 was allotted to the petitioner and shown as the 'E' Schedule property. The petitioner is 2/6

currently in possession of the property and seeks to have the patta transferred into her name.

3. Heard the learned Special Government Pleader appearing for the respondents.

4. Considering the facts and circumstances of the case, this Court directs the respondents to conduct the survey after issuing notice to the petitioner and other concerned parties. If required, the respondents may request police protection, and the jurisdictional police shall provide necessary protection during the survey. Upon completion, the respondents are directed to issue the patta in the name of the petitioner. The Court is also directing the Official respondents to adhere to the following Standard Operating Procedures: a. The Official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.

b. After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

c. If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties The said exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this order.
