The above petitions have been filed (i) to condone the delay of 91 days in filing the petition to set aside the abatement caused due to the death of the first respondent (ii) to set aside the abatement caused due to the death of the first respondent and (iii) to bring on record the proposed respondents 3 to 6 herein as legal representatives of the deceased first respondent and rank them as respondents 3 to 6 in the above appeal.

2.Heard the learned counsel for the petitioners and perused the records.

3.Despite receipt of notice, the respondents 3 to 5 have not turned up.

4.Records perused. Being satisfied with the reasons stated in the affidavit filed in support of these petitions, these petitions are ordered and the Registry is directed to carry out necessary amendment in the Civil Miscellaneous Appeal and list the matter on 02.06.2026.
