ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Sections 379 I.P.C and 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.139 of 2018, seeks anticipatory bail. 2.The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the contraband in question is two units of sand and they were recovered.

3.Taking into account of quantity of sand involved, the petitioner is directed to contribute a sum of Rs.5,000/- (Rupees five thousand only) to the credit of Chief Justice Relief Fund, Madurai Bench of Madras High Court, Madurai.

4.Subject to this Condition, this Court is inclined to grant anticipatory bail to the petitioner subject to certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Thiruvaiyaru and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and https://hcservices.ecourts.gov.in/hcservices/

on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
