ROBINSON, Government Advocate (Crl.Side) for the petitioner and of Mr.SELVA KUMAR, Advocate on behalf of the Respondent, the court made the following order:- The prosecution has filed this Criminal Miscellaneous Petition for cancelling the bail granted in favour of the respondent on 18.05.2018, in Crime No.23 of 2014 registered on the file of the Inspector of Police, NIB-CID Police Station, Kanyakumari, Kanyakumari District, for the offences under Sections 8(c) r/w 20(b) (ii)(C) of the Narcotic Drugs & Psychotropic Substances Act, 1985.

2. In this case, there are two accused. The Sessions Court has granted bail to the other accused and has recorded a finding that the said accused was in possession of 10kg Ganja. The prosecution did not challenge the said order granting bail. Therefore, there is no genuineness about as to whether the petitioner was in possession of 14 kg of Ganja, which is below the commercial quantity. https://hcservices.ecourts.gov.in/hcservices/

3. In this view of the matter, this Court is not inclined to

interfere with the bail order granted earlier. Hence, this Criminal Miscellaneous petition stands dismissed.
