PRAYER :- For Bail in Crime No.493 of 2020 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioners/A2 and A3 herein were arrested and remanded to judicial custody on 23.07.2020 for the alleged offences under Sections 394 r/w.397 of IPC.

2. There are totally four accused in this case. The petitioners herein is arrayed as A2 and A3. The case of the prosecution is that the petitioners along with other accused waylaid the defacto complainant, assaulted him and extracted Rs.500/- from the defacto complainant. Hence the complaint.

CRL OP(MD). No.8730 of 2020 the petitioners are innocent and a false case has been foisted against them.

4. The learned Additional Public Prosecutor would submit that the petitioners are habitual offender and several previous cases are pending against them. If they are released on bail, they will abscond again and indulge in similar type of offence.

5. Taking into consideration the fact that petitioners are habitual offenders having previous cases for various offences, this Court is not inclined to grant bail to the petitioners.

6. Hence the petition stands dismissed.
