RESPONDENT / COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition as the Petitioner shall appear before the Thiruvaiyaru Police Station or any other police Station,Thanjavur District,instead of the respondent police, in Crl.OP(MD)No.8325/2022 dated 29/4/2022.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.G.THALAIMUTHARASU, Advocate for the petitioner and of MR.A.ALBERT JAMES, Government Advocate (Crl. Side) on behalf of the Respondent, the court made the following order:- The case of the petitioner is that the petitioner was implicated as accused on the allegation that the petitioner and her husband have cheated to the tune of Rs.1,26,00,000/- by not paying the matured amount to the depositors. Thereby, the District Crime Branch, Sivagangai, registered a case against the accused persons. 2.This Court by order dated 29.04.2022 in Crl.O.P.(MD)No.8325 of 2022, granted bail to the petitioner herein and directed the petitioner to appear before the respondent police.

Aggrieved by the said condition, this petition has been filed. 3.The learned counsel for the petitioner submitted that the petitioner herein is the wife of the main accused and unless the condition, directing the petitioner to appear before the respondent police, is modified, the petitioner will be harassed by the respondent police.

CRL MP(MD) No.6055 of 2022 4.The learned Additional Public Prosecutor would submit that after getting the bail order, the petitioner and her husband have not appeared before the respondent police and not co-operated with the investigation. The petitioner herein has complied the condition only for four days and thereafter she has not appeared before the respondent police and the petitioner's husband is also absconding. Unless the petitioner and her husband co-operate the investigation, charge sheet, in this case, may not be filed. 5.Therefore, this Criminal miscellaneous petition is dismissed and the petitioner herein is directed to appear before the respondent police as directed by this Court vide order dated 29.04.2022 in Crl.O.P.(MD)No.8325 of 2022.
