[Order of the Court was made by The Hon'ble CHIEF JUSTICE] We have heard Mr.M.P.Senthil, learned counsel for the
petitioner, learned Government Advocate for the respondents 1 to 3 and learned counsel for the respondents 4 and 6.
2. Notice is issued under the provisions of the Tamil Nadu Urban Local Bodies Act, 1998. It is submitted that prior to the said order, no show cause notice was issued.
3. The learned Government Advocate submits that amendment has been made to the Tamil Nadu Urban Local Bodies Act, 1998 only on 13.04.2023, wherein show cause notice is contemplated.
4. Be that as it may, principles of natural justice require opportunity of giving explanation.
5. In light of that, we pass the following order: The impugned order dated 04.05.2023 shall be construed as a show cause notice. The petitioner shall file reply to the same within a period of ten days from today. After the reply is filed, the same shall be considered by the authority on its own merits, in
accordance with law and may take a decision. Depending upon the decision taken, the parties may take further steps.
6. The writ petition is disposed of accordingly. However, there is no order as to costs. Consequently connected Miscellaneous Petitions are closed.
